Updated: Pelletier Resigns from City Council
Councilman Robert J. Pelletier has resigned his City Council seat.
Councilman Robert J. Pelletier resigned from the City Council last night at the end of the Safety Services and Licensing Committee meeting.
Council President Anthony Lupino said in an e-mail message that Pelletier "will be missed for his dedication to his office and commitment to his constituents."
"I wish him well," Lupino said.
Lupino said to expect a Special City Council Meeting soon for the matter of his resignation to be discussed. Once he receives word from the Board of Canvassers on whether there will be a special election or if the council makes an appointment to fill the vacant seat, the council will take action.
In his resignation letter, Pelletier highlighted his work representing Ward 4 and said he always took the job of councilman "very seriously." But due to an impending hearing of the city's canvassing board about his residency, "I do not want to continue to let my own personal, financial hardships played out in the media any longer," Pelletier said.
"Also, I do not want to waste any taxpayer's time and money fighting something as trivial as where I slept after my home was sold at a short sale," Pelletier said.
It all started in December, when the Board of Canvassers received an anonymous letter notifying them that Pelletier had sold his house over the summer and was now living in Ward 1.
The canvassers took no action and forwarded the matter to the City Council. Their lawyer told them at last month's City Council meeting that Pelletier's residency was a voting rights issue and needed to be addressed by the Board of Canvassers and ultimately, the state Board of Elections if it got to that point. Pelletier abstained from that discussion and sat next to his lawyer in the audience. Meanwhile he had already moved back into Ward 4 and filed a notice of a change of address with the City Clerk's office.
"It has always been my intent to remain in the ward and to continue to serve my constituents while I got back on my feet again," Pelletier said. "It is a sad commentary that anyone would have to suffer this turmoil while we have bigger and more urgent issues facing this city. Even though I have been residing in the ward for some time now, I no longer want to fight this battle."
Many have argued that Pelletier vacated his seat the moment he moved out of his elected ward according to the City Charter, which states elected officials must live in the wards they represent. Among them is Board of Canvassers Chairman Joseph A. DeLorenzo Jr.
Today, in an interview, Pelletier said he wasn't sure if he'll run for his seat again.

It's sad to see one of the only hard working Councilman be forced to leave. Pelletier valued his service and truly cared about the "neighborhood". Although he deserves some blame for his actions, this was still a petty political witch hunt. I hope Mike Sepe, Joe D and the rest of those hack clowns are smiling this morning, because their well being is what really matters. It's all about their own interests, they could care less about Cranston. At the end of the day it's all about protecting absent-minded puppets on the Council. And if you stray away from the litter, Uncle Mike cuts your throat.
Pelletier could have stayed and fought and most likely won. But how much can a guy take especially after going through some heavy personal issues last year? Rumor has it Joe D. overstepped big time and the BOC subpoenaed all kinds of personal information. Like I said, the City Dems don't just cut you they slash your throat. Regardless Pelletier left honorably, without playing Sepe's game because quite frankly he could of took down all of them, especially Navarro and Santamaria.
Now let the gong show begin in Ward 4. What incapable puppet will Sepe drum up?

Sox, not sure where your coming from with the names your dropping.. But this came down to what is the law is the law.. It's atypical RI busienss as usual " johnny who ya know" politics that would turn the cheek on a "minor" infraction.. Simple as this .. He broke the law as a public official, No matter the good done it's washed away quickly by willingly breaking the charter rules.. How convienent he found "suitable" housing just 2 days after the city council called a meeting about his move out of Ward 4 ..
And to no suprise he's done the same thing here by resigning before what was to be a scheduled hearing tomorrow... He knew he couldnt beat it this time.. This should send a signal to all in City Council that business as usual days are gone !

I have to agree with you both.....he is one of the 'good guys' who bent over backwards to help the people of Cranston. Now if you want to talk about following the letter of the law go back and look at them all, I believe the charter also calls for a certain amount of required attendence, go check some of the so called minority dems fall short of that I believe.

To all, This was not a one "count" versus Pelletier, He has cosistently broken his word, starting with his "inside baseball" with Fung. I know what he did as I was running with him as the nominated Mayoral candidate. He tiped off the Mayor on my scheduled Press conference. His reward, among others was to get his then girl friend(her whole family worked for his last election) a job in city hall, at the same time simialr positions were being laid off. There's more, but this all goes to character and integrity, without which you can not and should not serve. It is all so sad but true!

Mr. Tomlins, if you want to make false accusations and insults toward those of us who are elected to office, you are well within your right to do so. But to level accusations that are seemingly unfounded against city employees is nothing short of cowardice. To make a point of this several years after the fact is embarrassing, if not slanderous, on your part. I would have expected more from a man of your stature.

Richard Tomlins aka Citizen Tomlins should get his facts straight. She took the test for the position before they dated AND she scored NUMBER ONE on the test, thus making her the first person the city had to call to offer the position to 6 months later when the other person retired. These facts have been given to Mr. Tomlins from the city's HR Department, but he continues to make these absurd unfounded remarks. Please get it right before you make accusations against innocent people.

NICE TRY. NO ONE WAS INNOCENT. IT WAS A SET UP FROM THE GET GO. WITH SEVERAL OTHERS BEING LAID OFF AT THE SAME TIME, ASK YOUR SELF THE QUESTION: WHY WAS SHE BROUGHT TO THE ATTENTION OF HR (THRU fUNG) JUST AT THAT MOMENT. YOU WERE NOT, OR WERE YOU ON THE SCENE? JUST IDENTIFY YOURSELF AND YOU MIGHT MAKE MORE SENSE! I WAS PART OF THAT CAMPAIGN. JUST FOR YOUR BIASED INFORMATION HE WAS DATING HER AT THAT TIME. I TRAVELED WITH HIM AND HER.DID YOU KNOW THAT HER FATHER SUCCESSFULLY GOT HIS MINONS AT THE ASSOC ALL TO VOTE FOR FUNG. PLEASE DON'T COMMENT UNLESS YOU WERE THERE! WANT MORE JUST ASK? SUCH AS I GOT THE INFO, BUT WITH A BIG WINK! CITIZEN TOMLINS. PS ARE YOU WILLING TO OVERLOOK HOW HE GOT TO BE THE VICE PRES. OF THE COUNCIL? AH SUCH INTEGRITY FROM HIS "FRIENDS"

I haven't been following Patch but I do follow the news. Mr. Tomlin, aren't you associated with the School Committee? If so, I'm certainly happy that my kids are adults & no longer attending Cranston schools! What a poorly written letter - time for you to take a remedial course in English. I'll excuse typing errors but if you can't construct a sentence or argue your point in a factual, orderly manner, you shouldn't be dabbling in the political arena or any public forum.
Additionally, wasn't it your vote that put us over the top re: CHW? I suggest that you & your 3 cohorts dig deep into your pockets to pay the ACLU, police details & any other costs associated with that. You, Mr. Traficante, were the most vehement, didn't consult a lawyer before opening your mouths. It was a done deal before you ever consulted Mr. Cavanagh. You made him look incompetent (he's not) - all he could do was damage control.
You are unacceptable in the public arena of this City. You've wasted our time, our resources, let your personal beliefs override issues rather than remain objective & to take into consideration what is best for all the citizens.
You & Mr. Traficante will not be in a position of power when November comes. To think that either of you has any influence on childrens education is frightening.
RE: Mr. Pelletier, I'm not in his ward, don't know his record. I know that living outside his ward's boundaries makes him ineligible to represent Ward 4 per the Cranston City Charter.

He made the right decision as he knew the truth would prevail and he didn't want all his dirty laundry aired!
Ward 4 deserves better than this. Rob "used" to be a good councilman however he got lost the few years for all the wrong reasons!
Good luck Rob you can now live free without worry who knows where you are sleeping at night!!!!

Rob Pelletier's decision to resign was the correct decision. He moved from the 4th ward and, therefore, he was ineligable to hold office according to the Cranston city charter. When he moved and where he moved to will be determined by the Cranston board of canvasses.
A legal challenge would have cost the taxpayers monies that this city could ill afford to spend.

Thank you John Lanni for that incredible legal analysis. It was almost as exciting as your gregarious personality! However you fail to mention the fascinating details of your involvement but I'm sure that was just an oversight. Anyway, I hope you and Mike Sepe are very happy this week, you got your guy!

Rob good luck, and thank you for your help. In most of the posts, there is truth in all, and it seems to be all political. Whether it be City Council or Associations, it seems the same thought process to help people is always present. Normal politcal behavior, that just costs money and time to taxpayers.
